Online Account Terms and Conditions (May 2018)

Please read the following Terms and Conditions and our Privacy Policy carefully. They apply to your access to your Likely Loans online account (“Online Account”). By accessing your Online Account you are agreeing to these terms. References to “we” “us” or “our” are references to Oakbrook Finance Limited, trading as Likely Loans and Appro Loans.

We may offer a number of services (“Account Services”) through the Online Account, including things like:

easy access to loan information such as the amount outstanding, dates for payments and number of payments remaining
the ability to view your personal information
where eligible, the ability to apply to top up your loan
manage your marketing preferences

Information submitted through the Online Account

The personal and financial information you provide to us will be used to provide you with the Account Services, to administer your loan with us and for the reasons set out in the Privacy Policy. You confirm that that all information provided is accurate and up to date. As stated in the Privacy Policy, if we suspect false or inaccurate information is provided or we suspect fraud, details will be passed to fraud prevention agencies who will investigate to prevent fraud and money laundering.

Usernames and passwords

If you are provided with or edit or select a username, password or any other piece of information as part of our security procedures, you must treat such information as confidential between you and us and you must not disclose it to anyone else. We have the right to disable access to the account or change any username or password, whether they were chosen by you or allocated by us, at any time if we feel it is necessary to safeguard the security of the Online Account or we believe you have failed to comply with these terms.

Service Communications

We may contact you with information relating to your loan. These include payment reminders sent by text message (SMS).

Availability

We will do our best to ensure you can access the Online Account at all times however there may be times when the Online Account is unavailable for a period of time. If the Online Account is going to be unavailable due to planned maintenance work, we will notify you as far in advance as is reasonably practicable and try to minimise any disruption.

We intend to add to the Account Services in future and may add new services. We may wholly or partially modify or remove existing services. We may decide to discontinue the Account Services.

We reserve the right to remove access to the Online Account on an individual basis if, at our own discretion, we decide that any user has acted in a manner which we consider to be unacceptable.

Intellectual property rights

We are the owner or the licensee of all intellectual property rights in the Online Account and the material published on it and we reserve all rights. The Likely Loans logo, name, branding and designs used on the Online Account are intellectual property belonging to us. We grant to you a non-exclusive, non-transferable, revocable licence for you to use the intellectual property in the Online Account for the Account Services and we will get our third party licensees to also grant you such a licence. You agree that you will not, and will not allow any third party to, change, copy, use or distribute the Online Account in any way other than in the exercise of the Account Services.

Liability

Nothing in these Terms and Conditions excludes our liability for fraud, death or personal injury arising from or caused by our negligence. To the extent permitted by law, we won’t be liable in any event (including negligence) for any damages or loss of any kind, including (without limitation) loss of profits, loss of sale or business, loss of agreement or contracts, loss of anticipated savings, loss of or damage to goodwill, loss of use or corruption of software, data or information, and any indirect or consequential loss arising as a result of your use of, or inability to access, the Online Account or its performance.

Privacy and Cookies

Use of the Online Account will result in the setting of cookies. For more information please see our Privacy Policy and Cookie Policy.

We reserve the right to place advertisements on our website including on the Online Account. These will be general advertisements relating to our products and services and possibly those of related third parties and will not be targeted or personal to you unless we have permission to do so.

Acceptable use

You must not use any Oakbrook Finance or Likely Loans website or Online Account in any way that causes, or may cause, damage to the website or Online Account or impairment of the availability or accessibility of the website or Online Account; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

Breach of these terms and conditions

Without prejudice to Oakbrook Finance’s other rights under these Terms and Conditions, if you breach these Terms and Conditions in any way, Oakbrook Finance may take such action as Oakbrook Finance deems appropriate to deal with the breach, including suspending your access to the website or Online Account, prohibiting you from accessing the website or Online Account, blocking computers using your IP address from accessing the website or Online Account, contacting your internet service provider to request that they block your access to the website or Online Account and/or bringing court proceedings against you.

Applicable law

These terms and conditions are governed by English law and you agree that the English courts shall have exclusive jurisdiction in relation to any matter or dispute connected to this Online Account and these Terms and Conditions.
